TERMS OF USE

These Terms and Conditions regulate the access and use of the services provided by Martín Malandra (hereinafter referred to as ‘the Company’) in the three tiers of service available: Landing Page, Eshop Basic and Eshop Premium. By contracting any tier of service, the customer agrees to be bound by these terms.

1. Acceptance of Terms

The customer, when contracting any of the service levels of Martín Malandra expressly accepts these terms and conditions. If you do not agree with any of the provisions, you must refrain from contracting or using the services.

2. Tiers of Service

Tier 1: Landing Page

This tier of service includes:

  • Customised development of products, services and sales strategies adapted to the client's needs.
  • One (1) weekly project follow-up meeting to review progress and resolve doubts.

  • Design, installation and operation of the website.
  • Personalised attention and support through means agreed with the client.
  • Creation of corporate email accounts associated with the client's domain.
  • The customer may cancel the service at any time, without conditions or penalties.

Tier 2: Eshop Basic

This level of service includes all the benefits of Tier 1, in addition to the following:

  • Online shop functionalities for the sale of physical and digital products.
  • Administration and maintenance of up to 500 items in the product catalogue.
  • Integration of electronic payment gateways such as PayPal, MercadoPago and credit/debit cards.
  • Editing of visual material for the articles in the online shop.

Tier 3: Eshop Premium

This level of service includes all the benefits of Tier 3, in addition to the following:

  • Email marketing integrations and automations for the optimisation of sales campaigns.
  • Administration and maintenance of up to 1000 items in the product catalogue.
  • Increased customisation of sales and promotional tools within the website.

3. Follow-up meetings

All service levels include a weekly follow-up meeting, which will be scheduled in agreement with the client. The purpose of these meetings is to review the progress of the project and to address any requests or queries.

4. Cancellation and Unsubscription

The customer may cancel the service at any time and without penalty. This cancellation implies the cessation of meetings, personalised support and the operation of the website. The client must give at least 48 hours written notice of his intention to cancel the service.

5. Intellectual Property

The content, design and development of the websites created by Martín Malandra are the property of the customer, once all agreed payments have been made. However, Martín Malandra reserves the right to use the project as part of his portfolio or for future demonstrations, unless otherwise agreed.

6. Technical Support and Maintenance

The Company undertakes to provide technical support and maintenance for the developed websites. Any technical issues will be dealt with within a reasonable period of time. This support includes the resolution of problems related to the functionality, security and software updates of the website.

7. Payment Gateways

For Eshop Basic and Eshop Premium, service tiers, payment gateways will be integrated in accordance with the policies and limitations of each provider (PayPal, MercadoPago and credit cards). The customer is responsible for complying with the regulations of each platform regarding the sale of their products.

8. Liability

Martín Malandra will not be responsible for:

  • Errors or interruptions in third-party services, such as payment gateways.
  • Damage or loss of information caused by external security attacks, such as viruses or cyber attacks.
  • Failure to meet delivery times due to causes beyond its control, such as natural disasters or failures in telecommunications services.

9. Modifications to the Terms

Martín Malandra reserves the right to change these terms and conditions at any time. Any changes will be communicated to the customer in advance and will apply to future services. In the event that the customer does not agree to the modifications, the customer may cancel the service without penalty.
